This website, Cosmic Tatva, is owned and operated by COSMIC TATVA LLP, a limited liability partnership registered in India ("Cosmic Tatva", "we", "us" or "our"). These Terms & Conditions ("Terms") govern your access to and use of the website and any purchase you make through it. By browsing the website, creating an account or placing an order, you agree to be bound by these Terms, together with our Privacy & Cookie Policy, Shipping & Delivery Policy and Return, Refund & Replacement Policy, which form part of these Terms. If you do not agree, please do not use the website.

1. Eligibility

You must be at least 18 years of age and capable of entering into a legally binding contract under the Indian Contract Act, 1872 to place an order. By using the website you represent that you meet this requirement. If you are under 18, you may use the website only with the involvement of a parent or guardian.

2. Your Account

  • You may browse and purchase as a guest or create an account. You agree to provide accurate, current and complete information when registering or placing an order, and to keep it updated.
  • You are responsible for keeping your password confidential and for all activity that occurs under your account. Notify us immediately at support@cosmictatva.com if you suspect unauthorised use.
  • We may suspend or terminate accounts that violate these Terms, are used for fraudulent activity, or repeatedly refuse Cash on Delivery orders.

3. Products

  • We sell fragrance and devotional products including perfumes, room sprays, car fresheners, dhoop and related items. Product descriptions, fragrance notes, images and specifications are provided for guidance and are as accurate as reasonably possible; however, colours, packaging and scent perception may vary slightly from what is shown or described, including between batches where natural ingredients are used.
  • Our products are for external use only and are not intended for consumption. Keep away from eyes, children and pets, and away from heat, flame and direct sunlight. Perfumes, sprays and fresheners may be flammable. Perform a patch test before applying perfume to skin and discontinue use if irritation occurs. Dhoop and incense must be burned in a well-ventilated area on a heat-resistant surface and never left unattended.
  • You are responsible for reading the product information and using products as directed. To the extent permitted by law, we are not liable for any allergic reaction, damage to surfaces, fabrics or vehicle interiors, or other loss arising from misuse or from a failure to follow the instructions.

4. Pricing & Taxes

  • All prices are quoted in Indian Rupees (INR) and are inclusive of GST unless stated otherwise. Shipping charges, where applicable, are shown separately in the cart and at checkout.
  • Prices, offers and coupons may change at any time without notice, but changes will not affect orders already confirmed.
  • Despite our best efforts, a product may occasionally be listed at an incorrect price or with incorrect information. If this affects your order, we will contact you before dispatch and you may choose to proceed at the correct price or cancel the order for a full refund of any amount paid.

5. Orders & Payment

  • Placing an order is an offer to purchase. An order is accepted and a contract formed only when we confirm it by email and, for prepaid orders, when payment has been successfully verified. We may refuse or cancel any order at our discretion, including for suspected fraud, pricing or stock errors, non-serviceable locations, or repeated Cash on Delivery refusals.
  • We accept the payment methods shown at checkout, which may include Cash on Delivery and online payment through our payment gateway (Razorpay) by UPI, cards, net banking or wallets. Online payments are processed by the gateway under its own terms; we do not store your card or banking details.
  • For Cash on Delivery, the full order amount must be paid to the courier at the time of delivery. We may confirm Cash on Delivery orders by phone, SMS or WhatsApp before dispatch, and may limit or decline Cash on Delivery at our discretion.
  • Coupons and offers are subject to their stated conditions, may not be combined unless stated, and may be withdrawn at any time.
  • An invoice will be issued for every order and made available by email and/or in your account.

6. Shipping & Delivery

Orders are shipped within India only, through third-party courier partners with whom we share the delivery details needed to fulfil your order. Processing and delivery timelines, shipping charges and the responsibilities of the customer are set out in our Shipping & Delivery Policy. Delivery dates are estimates and not guarantees, and risk in the goods passes to you on delivery.

7. No Return, No Refund — Replacement Only

  • Owing to the nature of our products, all sales are final. We do not accept returns and do not issue refunds for delivered orders, for any reason including change of mind or dislike of a fragrance.
  • The only exception is a free replacement of the same product where the bottle of a Car Freshener, Room Spray or Perfume arrives damaged, provided the damage is reported within 48 hours of delivery with valid proof (a continuous unboxing video and clear photographs). No replacement is offered for other products, and no cash refund is offered in place of a replacement.
  • Full conditions, exclusions and the claim procedure are set out in our Return, Refund & Replacement Policy, which you accept when placing an order.

8. Cancellations

You may cancel an order only before it has been dispatched, by emailing support@cosmictatva.com with your order number. Prepaid orders cancelled before dispatch, or cancelled by us, are refunded to the original payment method within 7–10 business days. Orders cannot be cancelled once handed to the courier.

9. Intellectual Property

All content on this website — including the Cosmic Tatva name and logo, product names, fragrance descriptions, images, videos, text, graphics and website design — is owned by or licensed to COSMIC TATVA LLP and is protected under Indian and international intellectual property laws. You may not copy, reproduce, distribute, modify or use any content for commercial purposes without our prior written permission.

10. Product Reviews & User Content

  • Reviews may be submitted only by registered customers and must reflect genuine, honest opinions about the product. Reviews must not be false, defamatory, abusive, obscene, infringing, promotional for other businesses, or otherwise unlawful.
  • By submitting a review or other content, you grant COSMIC TATVA LLP a perpetual, royalty-free, worldwide licence to use, display, reproduce and adapt it in connection with the website and our marketing.
  • We may moderate, edit or remove any review or content at our discretion without notice.

11. Acceptable Use

You agree not to use the website for any unlawful purpose; to place fraudulent, speculative or false orders; to submit false damage claims; to interfere with the website's security or operation; to scrape or harvest data; or to impersonate any person. We may block access, cancel orders and take legal action in response to any breach.

12. Privacy, Cookies & Advertising

We collect and process personal information as described in our Privacy & Cookie Policy. This includes the details you provide at checkout, sharing of delivery details with courier partners and payment details with our payment gateway, and the use of Google Analytics, Google Ads and Meta (Facebook/Instagram) advertising tools and cookies on the website. By using the website you consent to that processing.

13. Third-Party Links & Services

The website may contain links to third-party websites and services (such as our social media pages, the payment gateway or courier tracking pages). These are provided for convenience only; we do not control and are not responsible for their content, policies or practices.

14. Disclaimer & Limitation of Liability

  • The website and its content are provided on an "as is" and "as available" basis. We do not guarantee that the website will be uninterrupted, error-free or free of viruses, or that product descriptions or other content are complete or error-free.
  • To the fullest extent permitted by applicable law, COSMIC TATVA LLP, its partners, employees and agents shall not be liable for any indirect, incidental, special, consequential or punitive loss or damage, including loss of profits, data or goodwill, arising out of or in connection with your use of the website or any product purchased through it.
  • In all cases, our total liability to you in respect of any order shall not exceed the amount paid by you for that order.
  • Nothing in these Terms limits any liability that cannot be excluded under Indian law, including under the Consumer Protection Act, 2019.

15. Indemnity

You agree to indemnify and hold harmless COSMIC TATVA LLP and its partners, employees and agents from any claim, loss, liability or expense (including reasonable legal fees) arising from your breach of these Terms, your misuse of the website or products, or your violation of any law or third-party right.

16. Force Majeure

We are not liable for any failure or delay in performing our obligations caused by events beyond our reasonable control, including natural disasters, epidemics, strikes, courier or transport disruptions, government actions, power or internet failures.

17. Governing Law & Jurisdiction

These Terms and any dispute or claim arising out of or in connection with them, the website or any order shall be governed by and construed in accordance with the laws of India. Subject to any mandatory rights you have under the Consumer Protection Act, 2019, the courts located in the State of Gujarat, India shall have exclusive jurisdiction over any such dispute.

18. Grievance Redressal

In accordance with the Information Technology Act, 2000, the Consumer Protection (E-Commerce) Rules, 2020 and the rules made thereunder, any complaint or grievance regarding the website, an order or these Terms may be sent to our Grievance Officer at support@cosmictatva.com. We will acknowledge your complaint within 48 hours and aim to resolve it within one month of receipt.

19. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date above indicates the current version. The Terms in force at the time you place an order apply to that order. Continued use of the website after a change constitutes acceptance of the updated Terms.

20. General

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force. Our failure to enforce any right or provision is not a waiver of that right. These Terms, together with the policies referenced above, constitute the entire agreement between you and COSMIC TATVA LLP regarding your use of the website.
